We are pleased to announce the publication of Dr Anita Ferrara’s latest article, “Reconceptualising Transitional Justice as a Pluralistic Theory of Justice”, in the Social and Legal Studies Journal.
The article is available open access here: https://journals.sagepub.com/doi/10.1177/09646639261422354
The article argues that transitional justice should be reconceptualised as a pluralistic theory of justice, reflecting the coexistence of multiple justice approaches, including restorative, reparative, customary and historical that have emerged from practice across different societies dealing with the legacy of mass atrocities.
Drawing on legal pluralism and critical scholarship, the article suggests that transitional justice practices across different societies have produced diverse and overlapping conceptions of justice that challenge the traditional liberal-legalist framework, which primarily equates justice with criminal justice.
The piece reflects on how justice after mass atrocities is experienced and constructed across different contexts, and on why transitional justice theory needs to better capture this normative, socio-cultural and epistemic pluralism.
